CONNIVANCE
Origin: The English word "Connivance" is derived from the French word "connivence" or the Latin word "conniventia". It means an act of conniving.
Meaning:
The act of connivance happens —
i) when a person secretly assents to the conduct of an unlawful act, or
ii) when a person indirectly cooperates in a criminal act by another, or
iii) when a person allows another person to carry out an act of wrongdoing, or
iv) when a person encourages one or more persons to perform an immoral act, or
v) when a person intentionally fails to prevent an offence for his own good.
Example:
1) A bank robbery was conducted in broad daylight by the criminals with the connivance of the chief manager of the bank.
2) Mr. CaLito Corleone tried to bribe the police into connivance to safeguard his illegal drugs business.
3) With her mother's connivance, she met her boyfriend to murder her husband.
CONVEYANCE
Origin: The English word "Conveyance" is derived from the Old French word "convoiier", the Vulgar Latin word "conviare" and the Middle English word "conveien". These words essentially mean "to accompany with or to go along with or to carry/transport".
Meaning:
The general meaning of the word "conveyance" is —
to convey, to transport, to communicate, or to transmit. It is an act of conveying certain things or information.
The legal meaning of the word "conveyance" is —
i) the transfer of title (ownership) to property (whether movable or immovable) from one person to another,
ii) the written instrument or document which effects such a transfer of title (e.g. a deed).
Example:
1) The attorney was asked by his real-estate client to draw up a conveyance for the purchase of a new building.
2) VK Developers agrees to join in the execution of the Conveyance Documents in partnership with MKM Developers for the purchase of 2 acre land at Riviere, LA to build new apartments.
CONVENIENCE
Origin: The English word "Convenience" is derived from the Latin word "convenientia". It means "being in accord with each other".
Meaning:
In the legal context, "convenience" has different meanings —
i) In contracts, it refers to the right of a party to take a specific action or to make a change without needing to prove their fault or to provide any reasons behind your action, for example the termination for convenience clause in contracts, or popularly known as the "T for C" clause, whereby a party can end a contract instantly without giving any reason thereto to protect its best interest.
ii) The balance of convenience doctrine is a principle which helps the court to determine which party (plaintiff or defendant) would be more harmed if a temporary injunction is denied or granted.
iii) The rule of convenience doctrine in property law helps in determination of a class of beneficiaries in a gift or trust. The list of the class of beneficiaries is closed at the time of first priority principal distribution, wherein the children born after that point are excluded from receiving any share.
Example:
The Court held that ABC Limited had the right to end the contract with XYZ Limited without giving any reason for termination based on clause 19 of the contract between them, which signifies the right of ABC Ltd with regard to the termination for convenience.
