Section 42A, Arbitration & Conciliation Act 1996: Confidentiality of Info.

Section 42A (Confidentiality of information) is under Chapter X (Miscellaneous) of the Part I (Arbitration) of the Arbitration and Conciliation Act, 1996.—

“Notwithstanding anything contained in any other law for the time being in force, the arbitrator, the arbitral institution and the parties to the arbitration agreement shall maintain confidentiality of all arbitral proceedings except award where its disclosure is necessary for the purpose of implementation and enforcement of award.”

Extra Notes for Readers

(1) Section 42A of the Arbitration and Conciliation Act, 1996 was newly inserted by section 9 of the Arbitration and Conciliation (Amendment) Act, 2019, which received the assent of the President on 9th August, 2019 and was published on the same day in the Official Gazette.

(2) Section 9 of the Arbitration and Conciliation (Amendment) Act, 2019 came into force w.e.f. 30th August, 2019 vide notification dated the 30th August, 2019 by Ministry of Law and Justice (Department of Legal Affairs).
