Section 42B Arbitration & Conciliation Act 1996: Protection of action taken in good faith

Section 42B (Protection of action taken in good faith) is under Chapter X (Miscellaneous) of the Part I (Arbitration) of the Arbitration and Conciliation Act, 1996.—

“No suit or other legal proceedings shall lie against the arbitrator for anything which is in good faith done or intended to be done under this Act or the rules or regulations made thereunder.”

Extra Notes for Readers

(1) Section 42B of the Arbitration and Conciliation Act, 1996 was newly inserted by section 9 of the Arbitration and Conciliation (Amendment) Act, 2019, which received the assent of the President on 9th August, 2019 and was published on the same day in the Official Gazette.

(2) Section 9 of the Arbitration and Conciliation (Amendment) Act, 2019 came into force w.e.f. 30th August, 2019 vide notification dated the 30th August, 2019 by Ministry of Law and Justice (Department of Legal Affairs).
