Section 27 Contract Labour (R.&A.) Act 1970: Limitation of Prosecutions

Section 27 (Limitation of prosecutions) under Chapter VI (Penalties and Procedure) of the Contract Labour (Regulation and Abolition) Act, 1970 —

❝No court shall take cognizance of an offence punishable under this Act unless the complaint thereof is made within three months from the date on which the alleged commission of the offence came to the knowledge of an inspector:

 Provided that where the offence consists of disobeying a written order made by an inspector, complaint thereof may be made within six months of the date on which the offence is alleged to have been committed.❞

Notes:

The Contract Labour (Regulation and Abolition) Act, 1970 (No. 37 of 1970) was amended by:
- the Contract Labour (Regulation and Abolition) Amendment Act, 1986 (No. 14 of 1986) (w.e.f. 28-1-1986);
- the Delegated Legislation Provisions (Amendment) Act, 2004 (No. 04 of 2005) (w.e.f. 11-1-2005).
