Section 26 of Contract Labour (R&A) Act 1970: Cognizance of Offences

Section 26 (Cognizance of offences) under Chapter VI (Penalties and Procedure) of the Contract Labour (Regulation and Abolition) Act, 1970 —

❝No court shall take cognizance of any offence under this Act except on a complaint made by, or with the previous sanction in writing of, the inspector and no court inferior to that of a Presidency Magistrate or a magistrate of the first class shall try any offence punishable under this Act.❞

Notes:

The Contract Labour (Regulation and Abolition) Act, 1970 (No. 37 of 1970) was amended by:
- the Contract Labour (Regulation and Abolition) Amendment Act, 1986 (No. 14 of 1986) (w.e.f. 28-1-1986);
- the Delegated Legislation Provisions (Amendment) Act, 2004 (No. 04 of 2005) (w.e.f. 11-1-2005).
