Section 46 of Patents Act 1970: Form, Extent and Effect of Patent

Section 46 (Form, extent and effect of patent) under Chapter VIII (Grant of Patents and Rights Conferred thereby) of the Patents Act, 1970 ⦂―

❝(1) Every patent shall be in the prescribed form and shall have effect throughout India.

(2) A patent shall be granted for one invention only:

 Provided that it shall not be competent for any person in a suit or other proceeding to take any objection to a patent on the ground that it has been granted for more than one invention.❞

Notes:

The Patents Act, 1970 was amended by :
- the Patents (Amendment) Act, 1999 (No. 17 of 1999);
- the Patents (Amendment) Act, 2002 (No. 38 of 2002);
- the Patents (Amendment) Act, 2005 (No. 15 of 2005).
