Sec 41, Patents Act 1970: Finality of Orders of Controller & Central Govt

Section 41 (Finality of orders of Controller and Central Government) under Chapter VII (Provisions for Secrecy of Certain Inventions) of the Patents Act, 1970 ⦂―

❝All orders of the Controller giving directions as to secrecy as well as all orders of the Central Government under this Chapter shall be final and shall not be called in question in any court on any ground whatsoever.❞

The Patents Act, 1970 was amended by :

- the Patents (Amendment) Act, 1999 (No. 17 of 1999);

- the Patents (Amendment) Act, 2002 (No. 38 of 2002);

- the Patents (Amendment) Act, 2005 (No. 15 of 2005).
