Sec 88, Trade Marks Act 1999: Salaries, allowances & other terms of service

Section 88 (Salaries, allowances and other terms and conditions of service of Chairperson, Vice-Chairperson and other Members) under Chapter XI (Appellate Board) of Trade Marks Act 1999 ⦂‒

❝(1) The salaries and allowances payable to, and other terms and conditions of service (including pension, gratuity and other retirement benefits), of the Chairperson, Vice-Chairperson and other members shall be such as may be prescribed.

(2) Notwithstanding anything contained in sub-section (1), a person who, immediately before the date of assuming office as the Chairperson, Vice-Chairperson or other Member was in service of Government, shall be deemed to have retired from service on the date on which he enters upon office as the Chairperson, Vice-Chairperson or other Member.❞

(1) For the word "Chairman" or "Vice-Chairman", wherever it occurs, the word "Chairperson" or "Vice-Chairperson" were substituted by the Finance Act, 2017 (No. 7 of 2017), s.161, (w.e.f. 26-May-2017).
