Section 11, Consumer Protection Act 1986: Jurisdiction Of District Forum

Section 11 (Jurisdiction of the District Forum) under Chapter III (Consumer Disputes Redressal Agencies) of the Consumer Protection Act, 1986, is reproduced hereunder:—

(1) Subject to the other provisions of this Act, the District Forum shall have jurisdiction to entertain complaints where the value of the goods or services and the compensation, if any, claimed does not exceed rupees twenty lakhs.

(2) A complaint shall be instituted in a District Forum within the local limits of whose jurisdiction,—

  (a) the opposite party or each of the opposite parties, where there are more than one, at the time of the institution of the complaint, actually and voluntarily resides or carries on business or has a branch office or personally works for gain; or

  (b) any of the opposite parties, where there are more than one, at the time of the institution of the complaint, actually and voluntarily resides, or carries on business or has a branch office, or personally works for gain, provided that in such case either the permission of the District Forum is given, or the opposite parties who do not reside, or carry on business or have a branch office, or personally work for gain, as the case may be, acquiesce in such institution; or

  (c) the cause of action, wholly or in part, arises.





Extra Notes for Readers

(1) Modification by the Consumer Protection (Amendment) Act, 2002 (Act No. 62 of 2002), sec. 7, (w.e.f. 15-Mar-2003), as  follows:

 o in sub-section (1), the words "does not exceed rupees twenty lakhs" were substituted for the words "does not exceed rupees five lakhs".

(2) Modification by the Consumer Protection (Amendment) Act, 1993 (Act No. 50 of 1993), sec. 9, (w.e.f. 18-Jun-1993), as  follows:

 o in sub-section (1), the words "does not exceed rupees five lakhs" were substituted for the words "is less than rupees one lakh";

 o in sub-section (2),—
   o in clause (a), the words "carries on business or has a branch office or" were substituted for the words "carries on business or";
   o in clause (b), the words "carries on business or has a branch office" were substituted for the words "carries on business";
   o in clause (b), the words "carry on business or have a branch office" shall be substituted for the words "carry on business".
